Data Processing Agreement

Overview

This Data Processing Agreement ("DPA") forms part of our Terms of Service and reflects our commitment to protecting personal data in accordance with applicable data protection laws, including the GDPR.

Definitions

  • "Controller" means the entity which determines the purposes and means of the processing of personal data
  • "Processor" means Pikfile, which processes personal data on behalf of the Controller
  • "Personal Data" means any information relating to an identified or identifiable natural person
  • "Processing" means any operation performed on personal data

Processing of Data

Pikfile will:

  • Process personal data only on documented instructions from the Controller
  • Ensure that persons authorized to process personal data have committed to confidentiality
  • Implement appropriate technical and organizational security measures
  • Assist the Controller in responding to requests from data subjects
  • Notify the Controller without undue delay after becoming aware of a personal data breach

Sub-processors

Pikfile may engage sub-processors to assist in providing the services. We will inform customers of any intended changes concerning the addition or replacement of sub-processors.

Data Transfer

Any transfer of personal data to a third country or international organization will comply with applicable data protection laws and will be disclosed to the Controller.

Audit Rights

Pikfile will make available to the Controller all information necessary to demonstrate compliance with the obligations laid down in this DPA and allow for audits by the Controller or an auditor mandated by the Controller.
